Agreement Scope and Application

Welcome to DesignForge! These Terms of Service constitute a binding agreement between you and DesignForge regarding your enrollment in our UI/UX design courses, use of our educational platform, and participation in our learning community.

By enrolling in any DesignForge course, accessing our learning materials, or using our educational services, you acknowledge that you have read, understood, and agree to be bound by these terms. These terms are designed to create a positive, productive learning environment for all students pursuing careers in design.

We reserve the right to modify these terms to reflect changes in our educational programs, legal requirements, or industry standards. Material changes will be communicated to enrolled students with appropriate notice periods to ensure transparency and fairness.

Educational Service Terms and Usage Policy

Course Enrollment and Access

  • Enrollment Requirements: Students must be at least 16 years of age and provide accurate personal information during registration. International students must ensure they have appropriate visa status if attending in-person sessions.
  • Course Access Duration: Enrolled students receive lifetime access to course materials and recorded sessions, with ongoing support available during active enrollment periods and limited support for graduates.
  • Technical Requirements: Students are responsible for maintaining adequate internet connectivity, compatible devices, and current software versions required for design coursework including Figma, Adobe Creative Suite, and collaboration tools.
  • Payment Terms: Course fees are payable according to agreed schedules, with flexible payment plans available. Full payment is required before accessing premium course content and one-on-one mentorship sessions.

Acceptable Use Policy

  • Professional Conduct: Students must maintain professional, respectful communication in all interactions with instructors, mentors, and fellow students. Discriminatory, harassing, or disruptive behavior will not be tolerated.
  • Academic Integrity: Original work is required for all assignments and portfolio projects. While collaboration is encouraged, plagiarism, sharing assignment solutions, or misrepresenting others' work as your own violates our academic standards.
  • Resource Usage: Educational materials, course content, and proprietary teaching methods are provided exclusively for enrolled students' learning purposes and may not be redistributed, recorded, or shared with non-enrolled individuals.
  • Platform Security: Students must maintain secure login credentials, report security concerns promptly, and refrain from attempting to access restricted areas of our learning management system.

Service Availability and Limitations

  • Scheduled Maintenance: Our learning platform may be temporarily unavailable during scheduled maintenance windows, typically announced 48 hours in advance and conducted during low-usage periods.
  • Content Updates: Course materials are regularly updated to reflect current design trends, tools, and industry practices. Students receive notifications when significant updates are made to enrolled courses.
  • Support Response Times: Technical support is available during business hours with response times of 24-48 hours for non-urgent inquiries and same-day response for urgent technical issues affecting course access.
  • Instructor Availability: One-on-one mentorship sessions are scheduled based on instructor availability and student needs. Emergency support outside scheduled sessions may incur additional fees.

Account Terms and Conditions

  • Account Responsibility: Students are fully responsible for maintaining account security, including password strength and preventing unauthorized access. Account sharing with other individuals is strictly prohibited.
  • Profile Accuracy: Student profiles must contain accurate, current information to facilitate proper course delivery, career services, and alumni networking opportunities within the design community.
  • Data Ownership: Students retain ownership of original portfolio work and creative projects completed during coursework, while granting DesignForge limited rights to showcase student success stories and course outcomes.
  • Account Termination: Students may close accounts at any time, though access to course materials and support services will cease upon termination. Outstanding financial obligations remain due regardless of account status.

User Responsibilities and Legal Obligations

Student Conduct Requirements

Students are expected to conduct themselves professionally and respectfully in all educational settings, including virtual classrooms, peer collaboration sessions, industry networking events, and online community discussions.

This includes respecting diverse perspectives in design, providing constructive feedback to peers, maintaining confidentiality of sensitive project information, and representing DesignForge positively when engaging with industry professionals or potential employers.

Prohibited Activities and Violations

Academic Violations: Submitting work that is not your own, collaborating inappropriately on individual assignments, or misrepresenting your skill level or experience in ways that compromise your learning or others' educational experience.

Technology Misuse: Attempting to hack, disrupt, or gain unauthorized access to our systems, sharing login credentials, distributing malware, or using our platform for activities unrelated to your design education.

Content Violations: Sharing course materials with non-enrolled individuals, recording live sessions without permission, or using our educational content for commercial purposes without explicit authorization.

Community Disruption: Engaging in harassment, discrimination, spam, or other behaviors that create a negative learning environment for fellow students or interfere with instructional activities.

Content Guidelines and Standards

All content created, shared, or discussed within DesignForge programs must adhere to professional standards appropriate for the design industry. This includes portfolio work, peer feedback, forum discussions, and any materials shared during collaborative projects.

Students must respect intellectual property rights, properly attribute sources and inspiration, and avoid creating or sharing content that is discriminatory, offensive, or inappropriate for professional design contexts.

Age Requirements and Legal Capacity

Students must be at least 16 years of age to enroll independently in DesignForge programs. Students aged 16-17 require parental consent and involvement in the enrollment process, including agreement to these terms by a parent or legal guardian.

All students must have the legal capacity to enter into this agreement in their jurisdiction and must comply with local laws regarding online education, data sharing, and professional development activities.

Service Limitations and Disclaimers

Educational Outcomes Disclaimer

While we provide comprehensive UI/UX design education and career support, we cannot guarantee specific employment outcomes, salary levels, or career advancement results. Success depends on individual effort, market conditions, and personal circumstances.

Limitation of Liability

DesignForge's liability is limited to the fees paid for educational services. We are not liable for indirect, consequential, or punitive damages arising from course participation, technical issues, or career outcomes.

Service Modifications and Updates

We continuously improve our educational programs and may modify course content, teaching methods, platform features, or service offerings to reflect industry changes, student needs, and technological advances.

Termination Conditions

Either party may terminate the educational relationship with appropriate notice. DesignForge reserves the right to terminate student enrollment for violations of these terms, academic misconduct, or behaviors that disrupt the learning environment.

Technical Platform Limitations

Our learning platform is provided "as is" with reasonable efforts to maintain availability and functionality. We cannot guarantee uninterrupted service and are not liable for technical issues beyond our control that may affect course access.

Industry Changes and Relevance

The design industry evolves rapidly with new tools, techniques, and standards. While we strive to maintain current, relevant curriculum, students are responsible for continued learning and adaptation beyond formal coursework.

Legal Framework and Dispute Resolution

Governing Law and Jurisdiction

These Terms of Service are governed by the laws of Sri Lanka, specifically the educational regulations and consumer protection standards applicable to private educational institutions operating within the country.

Any legal disputes arising from these terms or your participation in DesignForge programs will be subject to the exclusive jurisdiction of the courts of Sri Lanka, with proceedings conducted in accordance with local legal procedures and standards.

Dispute Resolution Procedures

We encourage resolution of disputes through direct communication and good faith negotiation. Most concerns about courses, services, or platform issues can be resolved quickly through our student support team and academic administration.

For more serious disputes, we offer mediation services through qualified educational dispute resolution professionals before pursuing formal legal proceedings, helping to find mutually acceptable solutions while preserving the educational relationship.

Arbitration may be pursued for complex disputes, conducted by qualified arbitrators with experience in educational services and consumer protection, providing a more efficient alternative to traditional court proceedings.

Terms Modification Policy

We may update these terms periodically to reflect changes in our educational programs, legal requirements, or industry standards. Material changes affecting student rights, obligations, or financial terms will be communicated with at least 30 days' advance notice.

Students will be notified of significant changes through multiple channels including platform notifications, course announcements, and direct communication. Continued participation in courses after the effective date of changes constitutes acceptance of the modified terms.

Students who disagree with material changes may terminate their enrollment within the notice period and receive refunds for unused portions of prepaid educational services, calculated according to our established refund policies.
